Chancery - Land, Trusts & Probate
Members of 9 Park Place Chambers continue to provide unrivalled expertise on the Wales and Chester circuit for disputes over land. We represent parties engaged in all such matters, including planning and village green public inquiries and disputes over agricultural land, as well as all manner of boundary and rights of way disputes. We are also often instructed in trespass and adverse possession claims as well as cases which involve disputes over easements, highways, by-ways and map rectification. Our counsel frequently appear at the various courts and specialist jurisdiction tribunals which deal with land disputes, including HM Land Registry adjudications across Wales and beyond. Members have developed a particular expertise in leasehold enfranchisement and in matters concerning 'Right-to-Buy' legislation.
Our expertise extends to all contentious probate, trusts and other disputes dealing with the validity of a will or the interpretation of its provisions. Our counsel are habitually instructed in high-value and often acrimonious disputes which require the quality of representation in dealing with the key legal concepts which you would expect from a Tier 1 set in this sensitive and often fraught area of law.
We also advise and represent parties involved in Court of Protection litigation over disputed Deputyship appointments or in relation to Powers of Attorney, and the issues over property and assets, or ongoing and future care, which often flow from them. It is usual for Court of Protection disputes to feature either of these issues, but our caseload regularly involves complex matters with elements of both, including where serious allegations are made, such as the dissipation of assets of a protected person.
