New civil team newsletter OUT NOW!
date posted: 18/05/2010
The latest edition of the quarterly newsletter produced by members of the civil practice team at 9 Park Place is now being distributed to professional clients.
The new edition has a strong property theme with a feature article by Gareth Thomas on adverse possession claims and a pitfall created by the Land Registration Act 2002.
There are also notes by Justin Amos on Fidler v Secretary of State for Communities and Local Government [2010] EWHC 143 (Admin) where the appellant had deliberately concealed building operations and by Carys Williams on Hewett v First Plus Financial Group Plc [2010] EWCA Civ 312 where a claim to possession by a mortgagee under a legal charge was defeated by a defence of undue influence based on the concealment of an affair.
By way of a contrast to property matters an article by Phillip Morris looks at the significant changes to funding introduced by new road traffic protocols in the CPR.
