Chancery & Commercial:

Practice encompasses all areas of Chancery and commercial litigation, including personal and corporate insolvency, disputes relating to real property, the administration of estates and landlord and tenant work. Extensive experience of advocacy in the Chancery Division of the High Court and in the Mercantile Court. Non-contentious work includes drafting of documents in the Welsh language.

Administrative:

Substantial planning practice acting for local planning authorities, developers, individuals and interest groups. Regularly instructed to undertake public inquiry work in respect of compulsory purchase orders and, in particular, rights of way.

Handles judicial review for claimants and public authorities.

Common Law:

Contractual disputes of all kinds but with a growing emphasis on construction work.

Notable Cases :

Miller v Cawley [2002] EWCA Civ 1100 (submission of no case to answer)

Inquiry: McCarthy & Stone appeal in relation to development of sheltered accommodation within the Porthcawl Conservation Area.
Represented LPA – issues centred on design/massing within conservation area and upon affordable housing contribution given fall-back permission with no affordable housing contribution (February 2008).

Inquiry: Modification Order under the Wildlife and Countryside Act 1981.
Acted for developer who had purchased land from Order-Making Authority who subsequently applied to register a public right of way over development land (December 2007).

Roberts v Lady Cooper. Conveyance of land subject to agricultural tenancy, transmission of landlord’s covenant upon assignment, waiver and damages (November 2007).

National Library of Wales v Williams & Teesdale. Acted for Library in injunctive proceedings to secure preservation and return of the drawings of the late Sir Kyffin Williams which were bequeathed to the Library but found in a desk sold at auction to third party (September 2007).

DGD Machinery Ltd v Ceredigion CC before the Adjudicator to HM Land Registry.
Represented custodian of common land in resisting a claim for adverse possession (September 2007).

Inquiry: Paddle Homes appeal re land off Herbert Street, Bridgend.
Represented the LPA in case concerning development of former railway cutting within an urban area (April 2007).

Inquiry: Dol Gorwel. Appeal by Redrow Homes. Represented LPA (January 2007).

Re Kwun Fai Manufacturing Co. Acted for UK company in injunctive proceedings to obtain release of a bill of lading in respect of goods purchased from Chinese manufacturer, permission to serve outside the jurisdiction etc (January 2007)

Inquiry: Church Village By-pass (A473) CPO.
Acted for landowner taking issue with evidence regarding the existence of colonies of Marsh Fritillary Butterflies (October 2006).

Inquiry: Tregaron to Aberystwyth Cycle Route CPO.
Represented acquiring authority (July 2006).

Inquiry: Lafarge Aggregates Ltd and Caerphilly CBC.
Successfully represented two local authorities at a planning appeal re Mineral Transport Site at Crumlin which had implications for the Ebbw Vale to Cardiff pedestrian railway service (2003).

Recommendations :

Recommended in every edition of The Legal 500 since 2004 under Public Law and Planning. In the 2008 edition, for example, it was stated that he “ soon drills down to the essentials” in planning matters
